Terms of Service (AGB)
These Terms govern the ProductBackground service operated by 3DOfficeAT e.U., registered proprietor Marcel Hermann Hofer, Sebastian-Schrott-Straße 2, Tür 30, 6112 Wattens, Austria (Provider).
1. Scope of Application
These General Terms and Conditions (AGB) apply to all business relationships between the operator of this website (hereinafter: Provider) and its customers.
2. Subject of the Contract
The subject of the contract is the use of the AI image generation service provided by the Provider via the website.
The public ProductBackground skills-only plugin for ChatGPT and Codex provides creative instructions and visual-style guidance without a ProductBackground account. It uses the client's native image generator only where available; availability, usage limits, image rights and any client charges are governed by that client's terms. The plugin does not submit ProductBackground jobs or spend MP credits. Separately using our website or Shopify app may require an account and payment under that service's displayed conditions. A website link does not start a paid job or transfer your chat references or style brief.
3. Registration and User Account
To use the website image-generation service, the customer must register and create a user account. The customer is obliged to provide truthful and complete information during registration. The public skills-only plugin does not require a ProductBackground account.
4. Usage Rights
The customer receives a non-exclusive, non-transferable right to use the generated images for personal and commercial purposes, subject to the terms of the underlying AI model license.
5. Liability
The Provider is liable for intent and gross negligence. Further liability is excluded unless required by law.
6. AI-generated results
AI-generated images may contain visual errors, artifacts, inaccuracies, or results that differ from the customer's subjective expectations. Customers must review generated images before publication or commercial use.
7. Immediate performance and consumed credits
When expressly requested during checkout, access to the selected plan or credit package begins immediately. The approved MP credit cost is booked when a paid request is accepted. Technical failures return the refundable amount, and completed stages may remain chargeable. The account and completed request show charged, refunded, and final amounts. Used credits and generations already started or completed are not refundable solely because the customer dislikes the result.
8. Withdrawal and statutory rights
For digital content supplied immediately, the statutory right of withdrawal may be lost when supply begins after the customer's express consent and acknowledgement, to the extent permitted by applicable law. Mandatory rights concerning defective, unavailable, or non-conforming services remain unaffected. Further details are set out in the Refund Policy.
9. Product Studio references
Customers may upload product images to Product Studio only when they have the necessary rights to process those images. Product references must depict the same product when two views are supplied. The service uses the selected image provider (OpenAI or Google Gemini) to create the composition, and customers remain responsible for reviewing product identity, labels, trademarks, geometry, and suitability before commercial publication.
10. MP credit availability
Purchased MP credits do not expire. Monthly allowances expire one calendar month after their billing period ends, calculated in UTC with the last available day used for shorter months. Renewal does not extend an earlier allowance. Valid remaining credits stay available on the website after normal cancellation, subject to account verification, applicable limits, and account restrictions. API, MCP, and Shopify access remains subject to each channel's own requirements.
Older subscription balances without an expiry receive a separate advance notice at least seven days before a transition begins; their new deadline is one calendar month after that transition date. Already expired or revoked credits are not restored. When a technical refund is due after its original allowance expired, the eligible refunded amount receives 168 hours of replacement availability. Account displays applicable deadlines.
